Terms and Conditions

istream provides a subscription streaming service that allows our users to access entertainment content in the form of movies, series, skits, telenovelas, etc. These terms and conditions govern the use of the service. As used in these terms and conditions “our service”, &ldquoistream service” or &ldquothe service” refers to all the services that istream provides which enables you to discover and access its content, features and functionalities, user interfaces, and software.

1.1 To use certain features of the istream service, you must register for an account. You may be required to sign up with your mobile number via an OTP process to create a user account. You are solely responsible for maintaining the confidentiality of your account and you agree to accept responsibility for all activities that occur under your account.

1.2 The information you provide to istream, whether at registration/signup or at any other time, will be true, accurate, current, and complete. You should also ensure that this information is always kept accurate and up-to-date. If you have reason to believe that your account is no longer secure (e.g., in the event of a loss, theft, or unauthorized disclosure or use of your account ID), then you should immediately notify istream at [email protected]. You may be liable for the losses incurred by istream or others due to any unauthorized use of your account.

2.1 Billing
You will be charged a fee to be able to access the istream service. Payment for the istream subscription fee can be made via mobile money wallet. The user is required to approve a one-time auto-debit mandate which allows recurrent billing on your mobile money wallet to auto-renew your subscription to the service. The billing amount will depend on your subscription package (daily/weekly). The length of your subscription cycle will depend on the subscription package you choose during signup to the istream service i.e. daily or weekly. istream reserves the right to suspend a user's access to the service when a payment fails due to insufficient funds or any other reason that may cause subscription payments not to be settled successfully.

2.2 Cancellation
You can cancel your istream subscription at any time. To cancel your subscription, you can visit ‘my account’ and select ‘cancel subscription’ to cancel or dial *380*5# to revoke the auto-debit mandate to discontinue the auto-renewal of your subscription. A user may not receive a refund from istream after such cancellation. After canceling your subscription, you may continue to have access to the istream service through to the end of the paid subscription billing period.

2.3 Changes to Subscription Plans and Pricingistream may from time to time make changes to its subscription plans and fees. Any change to your subscription plan and fee will take effect no earlier than thirty (30) days after you have been notified of such change.

3.1 Proprietary Materials:
The service is owned and operated by istream. The visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), software, content, educational videos, and all other elements of istream are protected by international copyright, patent, and trademark laws, international conventions, and other applicable laws governing intellectual property and proprietary rights.

3.2 Licensed Content
istream grants you a non-exclusive, non-transferable right to access and use the content as made available on the service solely for your personal, non-commercial purposes. Unless expressly indicated on the service that a particular item of Licensed Content is made available to Users under other license terms, you may not distribute, sell, lease, or modify the licensed content on the istream platform.

3.3 Other Licenses:
In certain cases, istream or its licensors may make available licensed content under other license terms. By using, downloading, or otherwise accessing such licensed content, you agree to comply fully with all the terms and conditions of such other license.

4.1 Termination by istream:
istream, in its sole discretion, for any or no reason, and without penalty, may terminate any account (or any part thereof) you may have with istream or your use of the streaming platform and remove and discard all or any part of your account, User profile, and User Content at any time. istream may also in its sole discretion and at any time discontinue providing access to its service, or any part thereof, with or without notice. You agree that any termination of your access to the Service or any account you may have, or a portion thereof, may be affected without prior notice, and You agree that istream will not be liable to you or any third party for any such termination. Any suspected fraudulent, abusive, or illegal activity on the part of users may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies istream may have at law or in equity. As discussed herein, istream does not permit copyright, trademarks, or other intellectual property infringing activities on the service, and will terminate access to the service, and remove all User Content or other content submitted, by any Users who are found to be repeat infringers.

4.2 Termination by You:
If you are dissatisfied with (i) the istream service, (ii) any term of these Terms of Service, (iii) Guidelines, (iv) any policy or practice of istream in operating its platforms, or (v) any content or information transmitted through its platforms, you can terminate your account. You may terminate at any time by canceling the service and discontinuing the use of any parts of the service. You can also request the removal of your account by sending a request through the ‘contact us’ form available to users on istream.

You Agree Not to:

5.1 Use the istream service for any commercial use or purpose unless expressly permitted by istream in writing, it being understood that the istream service and related services are intended for personal, non-commercial use only;

5.2 Impersonate any person or entity, falsely claim an affiliation with any person or entity, access the accounts of others without permission, or perform any other fraudulent activity on istream;

5.3 Delete the copyright or other proprietary rights notices on the Service or any licensed content, licensed code, or user content;

5.4 Make unsolicited offers, advertisements, proposals, or send junk mail or spam to other Users of the istream service (including, but not limited to, unsolicited advertising, promotional materials, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures);

5.5 Use the istream service for any illegal purpose, or in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, data protection, and privacy;

5.6 Defame, harass, abuse, threaten, or defraud Users of the istream service, or collect, or attempt to collect, personal information about Users or third parties without their consent;

5.7 Remove, circumvent, disable, damage, or otherwise interfere with security-related features of the istream service, licensed content, licensed code, or user content, features that prevent or restrict the use or copying of any content accessible through the istream platforms, or features that enforce limitations on the use of the istream;

5.8 Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;

5.9 Modify, adapt, translate, or create derivative works based upon the istream service or any part thereof, except and only to the extent expressly permitted by istream herein or to the extent the foregoing restriction is expressly prohibited by applicable law;

5.10 Intentionally interfere with or damage the operation of the istream service or any user's enjoyment of it, by any means, including without limitation by participation in any denial-of-service type attacks or by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.

6.1 istream reserves the right, at our discretion, to change, modify, add, or remove portions of the Terms at any time. You may have to check the Terms and Conditions periodically for changes. Your continued use of the service after posting changes constitutes your binding acceptance of such changes.

6.2 Notice of Major Changes
For any major changes to the Terms, istream will make a reasonable effort to provide notice to you by Sms notification to the mobile number associated with your account or by posting a notice on its platform.

6.3 Dispute Resolution
Disputes arising under these Terms will be resolved by the version of the Terms in place at the time the dispute arose. istream shall be entitled to make policy declarations from time to time about matters and may alter the same from time to time at its sole discretion. All such policy decisions of the service shall be binding on the user and shall override this Agreement to that extent.
